Terms and conditions for using QuartzPath services

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and QuartzPath Interior Design Pte Ltd ("QuartzPath," "we," "us," or "our"). By accessing our website, using our services, or engaging us for interior design projects, you agree to be bound by these Terms.

2. Description of Services

QuartzPath provides interior design services including but not limited to:

  • Full interior design and renovation services
  • Space planning and optimization
  • Design consultation services
  • Custom storage solutions
  • Kitchen and bathroom renovation
  • Furniture selection and styling
  • Project management and coordination

3. Client Obligations

3.1 Accurate Information

You agree to provide accurate, complete, and up-to-date information regarding your project requirements, property details, and contact information.

3.2 Property Access

You agree to provide reasonable access to the property for consultation, measurement, design development, and project execution.

3.3 Timely Decisions

You agree to make timely decisions regarding design approvals, material selections, and other project-related matters to avoid delays.

3.4 Payment Obligations

You agree to pay all fees and charges according to the agreed payment schedule outlined in your project contract.

4. Project Process and Timeline

4.1 Consultation Phase

All projects begin with a consultation phase where we assess your needs, space, and requirements. No design work begins until a formal contract is signed.

4.2 Design Development

Timeline estimates are provided in good faith but may be subject to change due to factors including but not limited to permit delays, material availability, or client-requested changes.

4.3 Change Orders

Any changes to the original scope of work must be approved in writing and may result in additional costs and time delays.

5. Fees and Payment Terms

5.1 Consultation Fees

Initial consultations may be offered at no charge or for a nominal fee as specified at the time of booking.

5.2 Project Fees

Project fees are outlined in individual project contracts and may include design fees, project management fees, and procurement costs.

5.3 Payment Schedule

Payment schedules are typically structured as follows:

  • Design deposit: 30% upon contract signing
  • Progress payments: As outlined in project contract
  • Final payment: Upon project completion

5.4 Late Payments

Late payments may incur interest charges of 1.5% per month or the maximum allowed by law, whichever is less.

6. Intellectual Property

6.1 Design Ownership

All design concepts, drawings, plans, and specifications created by QuartzPath remain our intellectual property until full payment is received.

6.2 Usage Rights

Upon full payment, clients receive a non-exclusive license to use the designs for the specific project property only.

6.3 Portfolio Usage

QuartzPath reserves the right to photograph completed projects and use them for marketing and portfolio purposes unless specifically prohibited in writing.

7. Warranties and Disclaimers

7.1 Professional Standards

We warrant that our services will be performed in accordance with generally accepted professional standards in the interior design industry.

7.2 Third-Party Work

We do not warrant the performance of third-party contractors, suppliers, or manufacturers. Separate warranties may apply to materials and workmanship.

7.3 Limitation of Liability

Our liability is limited to the total amount paid for our services. We are not liable for indirect, consequential, or incidental damages.

8. Termination

8.1 Termination by Client

Clients may terminate projects with 14 days written notice. Fees for completed work and non-refundable expenses will be charged.

8.2 Termination by QuartzPath

We may terminate projects for breach of contract, non-payment, or other material violations with 7 days written notice.

8.3 Effect of Termination

Upon termination, clients must pay for all work completed and expenses incurred up to the termination date.

9. Force Majeure

Neither party shall be liable for delays or failures due to circumstances beyond their reasonable control, including but not limited to natural disasters, government actions, labor disputes, or material shortages.

10. Privacy and Confidentiality

We respect your privacy and maintain confidentiality of your personal information and project details. Please refer to our Privacy Policy for detailed information about data handling.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of Singapore.

11.2 Mediation

Disputes should first be addressed through good faith negotiation. If unsuccessful, disputes may be resolved through mediation.

11.3 Jurisdiction

Any legal proceedings shall be conducted in the courts of Singapore.

12. Website Terms

12.1 Acceptable Use

You may use our website for lawful purposes only. Prohibited activities include:

  • Attempting to gain unauthorized access
  • Interfering with website functionality
  • Submitting false or misleading information
  • Violating any applicable laws or regulations

12.2 Content Accuracy

While we strive for accuracy, website content is provided "as is" without warranties of any kind.

13. Communications

13.1 Electronic Communications

By using our services, you consent to receive communications electronically, including emails, text messages, and website notifications.

13.2 Marketing Communications

You may opt out of marketing communications at any time by following unsubscribe instructions or contacting us directly.

14. Compliance with Laws

All projects must comply with applicable Singapore building codes, regulations, and permit requirements. Clients are responsible for obtaining necessary permits unless specifically included in our scope of work.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with your project contract and our Privacy Policy, constitute the entire agreement between you and QuartzPath regarding our services.

17. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated through our website or direct notification. Continued use of our services constitutes acceptance of modified Terms.
